Public Records Requests

The Idaho Division of Human Resources (DHR) has adopted this Public Records Request Process in accordance and consistent with the Idaho Public Records Act, Idaho Code §74-101 through §74-127

Members of the public may request to examine or receive a copy of any public record, not otherwise exempt from public disclosure, in the custody and control of DHR and pertaining to the conduct or administration of DHR’s business.

Idaho Public Records Act

The Idaho Public Records Law states that “all records maintained by state and local government entities be available for public access and copying.” At the same time, Idaho recognizes the need to balance the policy of openness against the equally important need for privacy of certain information provided by citizens and businesses that is necessary for the government’s business.

Fees

  • No fee shall be charged for the first two (2) hours of labor in responding to a request for public records, or for copying the first one hundred (100) pages of paper records that are requested. Requests that require more than two (2) hours of labor, require more than 100 pages of paper record, or a request that requires records from which information must be redacted, may be charged the actual labor, and copying costs associated with fulfilling the request.

Timeframe

All requests for public records will be granted or denied within three (3) working days from the date a request is received.

  • If the request cannot be filled within three (3) working days, DHR may extend it to ten (10) working days from the date of receipt. The requester will be notified if this is the case.

Records Exempt from Disclosure

  • Personnel records of a current or former public official generally available to the public include the official’s public service or employment history, classification, pay grade and step, longevity, gross salary, and salary history, including bonuses, severance packages, other compensation or vouchered and unvouchered expenses for which reimbursement was paid, status, workplace and employing agency. All other personnel records of a current or former public official are generally confidential and exempt from public disclosure.
